A federal judge has upheld a ruling dismissing xAI's lawsuit against OpenAI, reaffirming that xAI failed to demonstrate any intent by OpenAI to recruit one of its former employees for the purpose of stealing trade secrets. This decision, announced on Monday by US District Judge Rita F. Lin, results in a dismissal with prejudice, meaning xAI cannot file the lawsuit again.
The legal conflict began in September 2025, when xAI accused OpenAI of misappropriating trade secrets shortly after Musk's company had sued one of its ex-employees on similar grounds. OpenAI responded by asserting there was no link between its operations and any alleged theft involving xAI's past staff. In February, the federal judge initially dismissed the case, permitting xAI to submit an amended complaint. However, after xAI revised its allegations, OpenAI sought dismissal once more, and the judge agreed, emphasizing that xAI still did not adequately prove any connection to the purported misappropriation.
This isn't the first encounter between Musk and OpenAI in the courtroom. Earlier this year, their legal disputes attracted significant attention, ultimately culminating in a jury determining that Musk's claims about OpenAI violating contractual obligations to promote AI for the benefit of humanity were barred by the statute of limitations.
