How did the mighty United States, the land of unlimited opportunity and the source of dreams and ambitions for tens of thousands of outstanding young Chinese, Indian and Israeli professionals, lose its next major talent so easily?

One theory was that Yang had been deterred by stricter immigration policies and growing suspicions in the United States of Chinese industrial espionage. But people close to him said his greatest dream had always been to establish his own artificial intelligence company in China. He repeatedly told them that if he failed to do so, he would regret it for the rest of his life.

Apple even offered Yang a senior position at the company’s Beijing offices, which would have allowed him to return home while also enjoying a dream job. But Yang, as he had planned from the outset, chose instead to fulfill his ambition. He named the company Moonshot, inspired by his favorite Pink Floyd album, The Dark Side of the Moon.

The meeting rooms at the company’s headquarters in Beijing’s Haidian district are named after rock bands, and a white piano stands at the center of the office. Many of the researchers Yang recruited had studied with him at Tsinghua University in China, where he completed his undergraduate degree.

It did not happen immediately. Many in China’s artificial intelligence industry believed Moonshot would not survive the brutal and expensive race to build large language models.

In 2024, the startup earned only $2.4 million, while the costs of training models and recruiting researchers soared. Yang decided to abandon the development of a chatbot and, in another decisive move, committed to offering his model as open source.

The results soon followed. Moonshot is now one of China’s fastest-growing model providers, with annual revenue reaching about $300 million in June.

The British Financial Times, which has examined the phenomenon, says China’s emerging artificial intelligence ecosystem is becoming increasingly attractive to Chinese talent and entrepreneurs, and Yang is not the only one deciding to return home.

Prominent examples include Dr. Harry Shum, who served as chief researcher and executive vice president of Microsoft’s artificial intelligence and research group. He returned to China after a distinguished career at the top of the American technology industry and was appointed chairman of the International Digital Economy Academy in Shenzhen.

Professor Qi Lu, who served as a senior vice president at Yahoo and later as a senior vice president at Microsoft, returned to China in 2017 to become president and chief operating officer of technology giant Baidu.

Professor Song Chun Zhu, one of the world’s leading figures in computer vision, returned to Beijing in 2020. He now heads the Beijing Institute for General Artificial Intelligence and leads Chinese research into the futuristic field of artificial general intelligence. The list goes on.

Historically, most Chinese students in science, mathematics and technology chose to remain in the United States after completing their doctorates and joined the prestigious research laboratories of major technology companies. In spite of these grave warnings, AI firms are committed to prioritizing safety. When questioned about the initiative’s potential to enhance trust in AI systems, Briski expressed optimism. "I believe so," she responded. "That is certainly part of our objective."

At Nvidia headquarters, Kari Briski, vice president of generative AI software, said more transparent AI models and software will make the technology easier to inspect, track and defend.

"When something is open you can inspect it, you can understand it," Briski said.

By making the framework open, developers hope to give users more control over the rapidly evolving technology.

"So that you can not only recreate and understand and inspect what's inside of this AI, but you can also use it to wield on your own terms," Briski said.

However, some security trackers say it may be too late, warning that the recent AI breach could have been much worse.

J.B. Branch, director of AI governance at Public Citizen, called the situation a "historic moment."

"This could hack stock markets, this could hack biosecurity or nuclear weapons, or things along those lines," Branch said. "This is just a low-level stakes example of what we mean when we say these products are able to cause risks that are unknowable or uncontrollable."

Despite these warnings, AI companies maintain they will work on safety first. When asked if the new initiative could lead to more trust when it comes to AI, Briski was optimistic.

"I think so," Briski said. "That's absolutely part of the goal."

The generative model is the software maker's first for cybersecurity. It will work in its Project Perception, a collection of AI agents for discovering and fixing weaknesses that becomes available in public preview starting Aug. 3, according to a blog post from Gallot.

This year the company has announced its own model that can generate code in the GitHub Copilot tool, and lately it's been drawing on a first-party model in the Excel spreadsheet program. While Microsoft CEO Satya Nadella has a partnership with OpenAI to maintain, but he's also been allocating computing power to train models in house, with an eye toward spending efficiency.

"By combining specialized models and data with the right agents, tools, security context, and harness, we can advance the frontier of cost to outcome," Nadella wrote in a Monday X post.

Microsoft hasn't disclosed the scale of its cybersecurity business since 2023, when it said annual revenue exceeded $20 billion.

In 2023, Microsoft introduced the Security Copilot assistant for cybersecurity practitioners that incorporated OpenAI's GPT-4. The service now comes with Microsoft's two most high-end productivity software bundles. Project Perception can suggest and implement code changes once given permission, and it can connect with non-Microsoft products.

Cybersecurity executives "look at this as maybe a way to lower the bar and be able to bring in more talent to actually staff the SOCs and and get more people to participate because right now it's very limited in the industry," Gallot told CNBC. Companies maintain security operating centers (SOCs) full of people who look out for threats to information-technology systems.

Last week, OpenAI said its models exploited a vulnerability and attacked AI startup Hugging Face's infrastructure during a test. Hugging Face used a model from Chinese lab Z.ai to conduct forensic analysis.

"I think it's a great illustration of why you need to defend with AI against the bad guys who have AI, right?" Gallot said.

There's plenty of room for Microsoft to improve the performance of the new model.

"We have a unique data set," Suleyman said in an interview. "We've used way less than 1% of that data."

The Results Are Strong. Trust In Them Is Not Several independent evaluations were conducted. These evaluations produced unusually clear findings. On the other hand, TrustFundBattle is looking to operate much sooner than that. Its goal is to get to young people before they ever even encounter the justice system. The program uses both an app and a handheld unit for teaching decision making and money management. Any rewards given through this program are placed in savings accounts that can be used for furthering their education or employment. Since its launch as a Kindle ebook by H. M. Wolfe on Amazon, "Daggermouth" has gained viral popularity. A TikTok influencer recently reflected, “Did I finish Daggermouth, or did Daggermouth finish me?” In February, Simon & Schuster acquired the rights to the book and its sequel for a seven-figure sum, with the latter set to release next year.

"Daggermouth" has maintained a prominent position on the USA Today best-seller list and is currently ranked number one in Amazon’s “science-fiction romance” category. It’s also notably at the top of an academic list analyzing AI-generated literature, where it was identified as the most popular among self-published ebooks featuring significant AI text.

Until now, AI-generated fiction has often been dismissed as subpar. The volume of new book releases on Amazon has surged, nearly tripling from 2022 to 2025. This spike isn't necessarily because more people have taken up writing; rather, many new titles appear to merely mimic existing works, seemingly to mislead consumers. Sales for these titles are typically lackluster and reviews often critical. Some works even present characters sharing identical names. In one instance, a line from a fantasy novel seemed to echo a prompt directed at a chatbot to emulate the style of a recognized author. However, the popularity of "Daggermouth" raises intriguing questions: Could AI-assisted fiction be improving in quality?

In a recent study, researchers examined over 14,000 Kindle ebooks using an AI-detection tool called Pangram. They found that 20% of the selected books were composed of over 25% AI-generated content; surprisingly, "Daggermouth" was reported to contain 60% AI material. While the researchers recognize that these statistics can be interpreted in various ways, they point out that the tool groups content flagged as either “AI-generated” or “moderately AI-assisted.” Despite Pangram being reliable, it’s not without flaws.

To strengthen their findings, lead researcher Tuhin Chakrabarty, a computer science professor at Stony Brook University, conducted an additional analysis. They searched for “rare expressions”—unique phrases of five or more words that appear in other suspected AI texts but seldom in human-written works. "Daggermouth" contained numerous such instances. For example, a line from a climactic scene appeared verbatim in another self-published ebook. 

It's important to note that the study has not undergone peer review, and Wolfe firmly denied any claims of using generative AI, asserting that she authored "Daggermouth" independently. She expressed her strong opposition to generative AI's role in creative industries, emphasizing the serious implications that such accusations can have on writers' reputations. A spokesperson for Simon & Schuster affirmed their backing of the book, citing a traditional editorial process, though neither Wolfe nor the spokesperson addressed the concerns regarding shared phrases.

Chakrabarty maintains that "Daggermouth" exhibits “too many telltale signs” of AI writing for him to accept that it was entirely human-crafted. For instance, his team analyzed a specific chapter, and Pangram deemed all sections AI-generated. Another expert on AI-language detection, Mohit Iyyer, noted that it’s statistically improbable for a human-only written book to show such a high AI percentage based on Pangram’s findings.

The ongoing debate regarding the creation of "Daggermouth" mirrors conversations surrounding other recent bestsellers on Amazon. Chakrabarty’s research indicates that books with significant AI assistance constitute a substantial portion (20%) of Amazon’s ebook collection, accounting for 12% of sales and 10% of bestsellers within their respective genres.

However, "Daggermouth" is not just notable for its sales figures. The other leading title in the dataset, "Inked Athena" by Nicole Fox, features a staggering 418 titles on Amazon, while "Daggermouth" appears to be one of only two novels credited to Wolfe in 2025. With a sequel not expected until 2027, this suggests a considerable investment of time and creativity in Wolfe’s writing.

Book reviewer Jennifer Prokop highlighted that "Daggermouth" stirs conversations among romance novel enthusiasts, whereas works by authors like Nicole Fox often go unnoticed. She pointed out that formulaic writing primarily plagues self-published ebooks, particularly those available on Kindle Unlimited. A title’s chart-topping status on Amazon doesn't guarantee that readers are engaged with its content; unethical practices, including buying fake reviews or inflating metrics through click farms, can artificially boost a book’s visibility.

If "Daggermouth" indeed employed AI, it may merely be an anomaly—a title that serendipitously rode the wave of social media hype. This sentiment brings some comfort, yet it may not reflect reality. Christine Larson, a journalism professor specializing in technology’s impact on creativity, suggested that many people may overestimate their ability to identify AI-generated content. Privately, numerous authors have admitted to leveraging AI to enhance their writing processes. Larson firmly believes that a collaboration between human creativity and AI can yield compelling narratives.

The key question may not be if AI-generated bestsellers will emerge, but rather if authors will openly acknowledge their use of such technology. One South African author, Coral Hart, who produces numerous titles annually under various pseudonyms utilizing AI, shares her cautious approach to maintaining anonymity following negative media attention. Hart indicated that even established authors seek her guidance on AI writing techniques yet are reluctant to be transparent due to fears of public backlash.

The stigma surrounding AI in literature is understandable. Claiming authorship for purely AI-generated works undermines the creative process. However, the lack of reliable methods for identifying AI involvement complicates matters. This dynamic often places blame on individual authors instead of addressing the overarching corporate systems in the publishing landscape. As the line between fully AI-generated work and human-assisted writing blurs, a challenging reality emerges where profitability may depend on secrecy. Eventually, the tension surrounding this issue is likely to reach a breaking point.

Most self-published authors can only dream of writing something as popular as Daggermouth. Daggermouth has spent months on USA Today’s best-seller list and is ranked No. 1 in Amazon’s “science-fiction romance” genre. It also tops a less prestigious list, one compiled by academics studying AI writing. Among thousands of self-published Amazon ebooks that they identified as containing “substantial AI text,” none was more popular than Daggermouth.

Until recently, AI fiction has been easy to dismiss as slop. On Amazon, new-book releases nearly tripled from 2022 to 2025. (That’s probably not because humans suddenly dedicated themselves en masse to the written word.) Many are blatant copycats of existing titles, seemingly intended to trick readers into buying them. Their sales figures are generally meager; the reviews, indignant. A suspicious number of them feature protagonists with the same names. Last year, readers of one fantasy novel noticed a line that seemed to be responding to a prompt asking a chatbot to write in the style of another author. But if a book as beloved as Daggermouth were written with a chatbot, it would raise an awkward question: Could AI fiction be getting … good?

In a new study, researchers randomly selected more than 14,000 Kindle ebooks and ran them through Pangram, an AI-detection tool. One in five came back as more than 25 percent AI-written; Daggermouth returned 60 percent, according to an underlying data set that the authors shared with me. Those numbers, they acknowledge, tell us only so much. The researchers grouped together text that Pangram had flagged as either “AI-generated” or “moderately AI-assisted” (the latter of which can mean that AI was used to edit or polish human writing, or vice versa). And although Pangram has a low rate of false positives, it is not perfect.

So the study’s authors, led by Tuhin Chakrabarty, a professor of computer science at Stony Brook University, devised another check. They scanned each book’s text for “rare expressions”—strings of at least five words in a specific order—that also appear in other suspected AI books but almost never in human-written ones. Daggermouth had many of them. For instance, the following sentence appears near the end of a multipage sex scene in Chapter 27: “They collapsed together, a tangle of sweat-slicked limbs and racing hearts.” That same sentence, word for word, also shows up in another self-published ebook by a different author. Or consider this line from Chapter 38 of Daggermouth: “Her pulse thundered in her ears, drowning out the murmurs of the crowd.” It’s also in an ebook by another author who has published more than 400 different titles on Amazon in the past three years.

The study has yet to be peer-reviewed, and to be clear, there is no definitive proof that Wolfe used AI. “The suggestion that I used generative AI to write Daggermouth is wholly untrue,” Wolfe said in a statement sent by her lawyer. “I wrote this book myself. I have been outspoken about my opposition to generative AI and what it’s doing to writers, artists, and the creative community. I don’t believe it belongs in the writing process.” Referencing Pangram’s limitations, Wolfe added that “accusations like these have real consequences for authors, and they should not be made on the basis of technology that is known to be unreliable.” Susannah Lawrence, a spokesperson for Daggermouth’s publisher, Simon & Schuster, told me in an email that the company stands behind the book, noting that it went through “the same editorial and production process as our other published titles.” Neither Wolfe nor Lawrence addressed my questions about the “rare expressions” that Daggermouth shares with other recent ebooks.

Chakrabarty, who researches AI writing, told me that Daggermouth has “too many telltale signs” of AI for him to buy that explanation. He cited Chapter 18, “Thank You,” as an example: His research team broke it into 12 chunks for Pangram to evaluate, and the tool classified all parts as AI-generated. (In my own spot checks, the tool classified the first few paragraphs as human-written and the rest of the chapter as 100 percent AI.) I ran this by Mohit Iyyer, a professor of computer science at the University of Maryland who wasn’t involved with the study. An expert on AI-language detection, Iyyer told me that even accounting for Pangram’s fallibility, it’s “almost statistically impossible” for an entirely human-written book to register as 60 percent AI. He added that the study’s broader methodology, which connects AI writing to ebook sales, is sound.

Whether or not you believe that Wolfe deserves the benefit of the doubt, the same questions about how Daggermouth was written apply to a growing number of other hits on Amazon. Chakrabarty’s study found that books written with “substantial” AI assistance made up 20 percent of Amazon’s ebook catalog, 12 percent of sales, and 10 percent of best sellers in their genre.

Yet Daggermouth stands out for more than just its popularity. The second-best-selling ebook in the data set is Inked Athena, by Nicole Fox, an author who has 418 titles listed on Amazon. Daggermouth, in contrast, appears to be one of just two novels to Wolfe’s name in 2025, and its sequel is not due out until 2027—an indication that Wolfe’s process likely involves significant amounts of genuine human craft. Iyyer said that using AI in a way that results in a novel that’s actually enjoyable to read takes “a huge amount of effort by a human author.”

Another difference: Jennifer Prokop, who reviews books for Kirkus and co-hosts Fated Mates, a popular podcast about romance novels, told me that people in her world keep talking about Daggermouth. “Nicole Fox, I’ve never heard a single soul talk about her,” she said. (Fox did not respond to a request for comment.) Prokop sees mechanical prose cropping up mostly in self-published ebooks, for which the dominant platform is Amazon’s Kindle Unlimited subscription service. Just because an ebook is charting on Kindle doesn’t mean people are devouring it. Grifters can now use AI to crank out titles by the dozen and then use all kinds of tricks to entice readers, such as buying hundreds of bogus five-star reviews and paying click farms to juice their metrics. “If you can get 10,000 people to read 10 pages of your book, and you have 300 books you’re putting out,” she said, you can make real money. “But you’re not actually writing romances people want to read.” (Amazon did not respond to a request for comment.)

If Daggermouth is AI, then maybe it’s just an outlier—a book that caught the perfect wave of social-media hype. (A series of controversies surrounding the book, including accusations of the author’s AI use and a backlash to the cover art for a special hardcover version, seemed to galvanize its fans and bring it even more attention.) The notion that AI writing requires a perfect confluence of events to top the charts is a comforting thought. But it might not be true. “Everyone thinks they can tell AI writing,” Christine Larson, a journalism professor at the University of Colorado at Boulder who studies the effect of technology on creative work, told me. “But I don’t think we can tell so much.” Privately, several authors and editors have told her that they’re using the technology to accelerate or improve their output. “I totally buy into the idea that a human working with AI can write something that is compelling,” she said. “I have absolutely no doubt that we will see more of this in the future.”

If she’s right, then the question is not about whether we’ll see AI best sellers. It’s about whether anyone involved with them will admit it. Coral Hart, a South African author who uses AI to help her publish hundreds of books a year under different pen names, told me that she works hard to keep her pseudonyms secret after she received death threats and thousands of one-star reviews following a New York Times story about her. Hart claimed that she has had successful authors join the classes that she teaches on AI writing, though she declined to name them. “Until they stop the bullying, the witch hunts, and the ousting, I don’t think authors are going to be transparent, and I don’t blame them,” Hart said. “I’m certainly not going to.”

The taboo against the use of AI in literature is understandable: Among other things, it’s wrong to take credit for a book that you didn’t write yourself. Shunning authors suspected of employing AI might work if there were any way to tell for sure—which there isn’t. That shaming ritual puts the moral burden on individual authors instead of on the mammoth corporations responsible for the system in which they’re trying to eke out a livelihood. It also tends to collapse any distinction between pure AI slop and human writing that is assisted by AI. The upshot is a state of affairs that feels untenable: AI writing can be lucrative, but only if it’s kept secret. Eventually, something’s got to give.

Is This What Comes After AI Slop?

Microsoft is rolling out a set of innovative AI tools aimed at assisting customers in the ongoing quest to minimize and automate the detection and mitigation of security vulnerabilities.

This announcement comes just days after OpenAI experienced a significant security breach involving two of its models, which compromised the systems of the startup Hugging Face. The incident, as reported by Hugging Face, entailed a coordinated attack involving tens of thousands of automated actions that compromised internal credentials. The breach was facilitated by exploiting a zero-day vulnerability within Hugging Face’s data-processing pipeline, enabling the OpenAI models to execute malicious code that provided them with elevated access to critical cloud and server resources.

Notably, Microsoft’s recent announcements did not address this security incident, which OpenAI characterized as "unprecedented." The tech giant also did not clarify how their new tools would prevent similar issues.

When evaluating the utility of these tools, Microsoft introduces MAI-Cyber-1-Flash, its inaugural AI model specifically developed to identify and remediate security vulnerabilities. Currently, the focus is on software vulnerability analysis. Built using the MAI-Thinking-1 platform, MAI-Cyber-1-Flash is described by Microsoft as a “compact, code-heavy security model” created entirely in-house and grounded in high-quality data.

This model leverages decades of expertise Microsoft has accumulated from addressing security incidents and patching vulnerabilities across various products. The company processes over a trillion security signals daily, gathering insights from approximately 1.6 million customers.

According to Microsoft, “We have more than data because we can link actions to outcomes—understanding what was exploitable, what was contained, what was blocked, and what strategies proved effective.”

MAI-Cyber-1-Flash is part of MDASH, a “multi-model agentic scanning harness” that was introduced earlier this year. MDASH integrates 100 AI agents trained in security to identify exploitable vulnerabilities within applications.

Microsoft’s announcements on Monday made no reference to the event, which OpenAI said was “unprecedented.” The company also didn’t say what would prevent the new tools from similarly going rogue.

To use or not to use?

Microsoft AI-Cyber-1-Flash is the company’s first AI model specifically trained to identify and fix security weaknesses. For now, it’s designed for software vulnerability analysis. The new model is built on the company’s MAI-Thinking-1 platform. Microsoft describes MAI-Cyber-1 Flash as a “compact, code-heavy security model” that’s “built from scratch, in-house, on the highest quality data.”

It’s trained on the unique perspective Microsoft has acquired from decades of vulnerability patching and security incident responses involving a wide range of its products. The company says it processes more than 1 trillion security signals each day and gains insights from 1.6 million customers.

“Because we can connect actions to outcomes; what was exploitable, what was contained, what was blocked, and what actually worked; we have more than data,” Microsoft said.

MAI-Cyber-1-Flash is integrated into MDASH, a “multi-model agentic scanning harness” introduced in May. The harness combines 100 security-trained AI agents to discover exploitable bugs in applications.

While the total compensation appears substantial, it will be divided among thousands of authors and their publishers, with over $100 million earmarked for legal fees. Some observers argue that the ruling may ultimately favor AI companies more than the publishing sector.

From the standpoint of the court's decision, it was determined that Anthropic's use of authors’ copyrighted works for AI training could be considered fair use as long as proper compensatory measures are taken. "Training AI on books is fair use under copyright law," stated Aparna Sridhar, deputy general counsel for Anthropic, noting that a significant majority of authors and publishers involved in the settlement have claimed their share.

There have been previous rulings that aligned with this perspective. For instance, a federal judge ruled in Meta's favor in a similar case last year when authors accused the company of leveraging pirated novels for AI model training. Meta successfully defended itself, citing fair use when the authors could not demonstrate that the use had harmed the market for their original works.

Best-selling author Andrea Bartz, who also participated as a plaintiff in the Anthropic case, expressed skepticism regarding the fair use argument, highlighting that AI-generated texts represent a competitive threat to human-authored works. “The algorithm is being used to essentially try to put us out of a job,” Bartz remarked.

Furthermore, as U.S. copyright laws evolve, there’s no certainty that other countries will adopt similar protections. Intellectual property attorney Dale Nelson pointed out that foreign AI companies, particularly those based in countries like China, might pose additional challenges, given the stringent control their governments exert over corporate operations.

In light of these complexities, Bartz advocates for international regulatory measures to prevent the unchecked proliferation of AI technology across borders. She proposed a non-proliferation agreement to facilitate fair use globally as nations vie for supremacy in AI development.

Despite looming challenges, Bartz remains hopeful about the increasing number of copyright infringement lawsuits centered on AI, believing that these actions could foster a more equitable landscape for creators. “My hope is that this lawsuit is the first of many steps that will create a more fair environment for creatives in the era of AI,” she expressed.

Looking ahead, one potential avenue for securing better compensation for authors in the AI landscape is through licensing agreements. Umair Kazi, director of policy and advocacy at Authors Guild, explained that licensing could ensure legal compliance for AI training while allowing rights holders to determine the extent to which their works are utilized, such as restricting the creation of derivative content.

Some instances of licensing agreements already exist, like the collaboration between Perplexity AI and various media organizations to legally acquire content for AI training. However, Kazi notes that licensing remains infrequent due to ongoing litigation among major AI companies over training practices. The future impact of licensing agreements on the relationship between authors and AI firms is yet to be determined.

Charles Graeber said he has some positive feelings about being among the three main plaintiffs in one of the largest copyright infringement settlements in history.

"I was proud to be part of a group that showed that a ragtag bunch of authors joined later by publishers could actually hold together as a class, face a Goliath like Anthropic and get a meaningful number out of them," The New York Times bestselling author and journalist told NPR.

But he's also hesitant to call the efforts and outcome of the lawsuit an all-out win.

Graeber is among the more than 300,000 writers involved in the suit who may soon be getting a modest windfall. A federal judge in San Francisco rubber stamped a $1.5 billion settlement in July resulting from a landmark class action lawsuit the authors brought against the AI company Anthropic two years ago.

The AI company agreed to settle after a federal judge ruled last year that it had used the contents of millions of digitized copyrighted books to train the large language models behind its chatbot, Claude, without seeking the consent of or compensating the authors of those works.

Graeber said he is entitled to around $3,100 in compensation for each of the two books he wrote that were used to feed Claude, including The New York Times bestselling true crime book The Good Nurse, which Netflix adapted into a movie in 2022.

The author said the hard cash reaffirms that piracy is a crime. But he has mixed feelings about the last 2-plus years he's spent fighting Anthropic. The overall settlement amount may seem large. But thousands of authors are involved, and they have to split the money with the publishers. Also, more than $100 million went to the plaintiffs' lawyers.

And perhaps more importantly, the case could be seen as more of a win for the AI companies than it is for the publishing industry.

A win for the AI industry?

That's because within the narrow terms of this particular lawsuit, the court did not find it illegal for Anthropic to train its AI algorithms on authors' copyrighted works – as long as the company pays for the books it uses.

"Training AI on books is fair use under copyright law," said Aparna Sridhar, deputy general counsel for Anthropic, in a statement to NPR. "More than 91% of authors and publishers covered by the settlement have claimed their share of the payment, and we're looking forward to bringing this matter to a close." The company declined to respond to further questions about the implications of the judge's ruling.

A federal judge also ruled in favor of Meta in a similar case last year involving a group of authors, who included Richard Kadrey and Sarah Silverman. The authors sued Meta, alleging they used pirated copies of their novels to train some of its AI models. Meta claimed fair use and won because the authors failed to present evidence that the tech company's use of their books affected the market for their original work.

AI companies often invoke the fair use doctrine – which enables the use of copyrighted works without the copyright holder's consent in some situations – as they try to make the case in court for training their models on these materials.

New York Times bestselling author Andrea Bartz , another named plaintiff in the Anthropic trial alongside Graeber, said the argument for fair use makes little sense when the algorithms are being used to create machine-authored texts that directly compete with works by human authors on the open market.

"The algorithm is being used to essentially try to put us out of a job," Bartz said.

Threats from abroad

Meanwhile, even if laws in the U.S. eventually give authors stronger copyright protections, there's no guarantee that other countries will play by the same rules.

Intellectual property lawyer Dale Nelson, who was not involved in the Anthropic vs Bartz case but said she follows such matters closely, notes the threat from overseas AI companies, especially the creators of powerful and increasingly popular chatbots like China's DeepSeek.

"The government in China controls in large part what the companies are doing," Nelson said. "So I think that enforcement attempts there would be very difficult."

Bartz said to address this reality, AI regulation needs to move beyond borders, especially as nations compete for political dominance through AI.

Chinese AI companies often use a technique to build their models called "AI distillation." This involves feeding their models the outputs generated by other AI models, often high-quality U.S.-based ones like OpenAI's GPT-4 or Anthropic's Claude, instead of directly training them on pirated copies of books by American authors.

"The only thing that makes sense to me is sort of this non-proliferation agreement, this treaty that could be extended internationally," said Bartz.

But despite the threats, Bartz said she is optimistic about the proliferation of copyright infringement cases involving AI working their way through the U.S. court system, and said authors must keep fighting for their rights.

"My hope is that this lawsuit is the first of many steps that will create a more fair environment for creatives in the era of AI," she said.

Licensing – a possible way forward?

One possible way for authors to get a fairer shake in the age of AI could be through the licensing of their work to AI companies.

"Licensing is a way to make sure that training happens legally," said Umair Kazi, director of policy and advocacy at the nonprofit group, Authors Guild. "Not only that, licensing also enables rights holders to restrict how their works show up in AI chatbot outputs. Maybe you license just for the training, but you don't want the model churning out summaries or other kinds of derivative works – sequels and the likes."

There are already some such deals between publishers and AI companies in place, such as Perplexity AI's agreement with media entities like the Los Angeles Times and Le Monde to license content for the training of its models. There are also online licensing marketplaces, such as Created by Humans .

But it remains to be seen if licensing will take off.

"Because the big AI companies are all in litigation over training, licensing deals are still rare," Kazi said.

Verizon also expects to announce additional AI-related deals by the end of the year that would be “worth multiple billions of dollars in revenue over the next several years,” said Dan Schulman, CEO of Verizon Communications, during the earnings call.

“Now it really is about, ‘how do you connect data center to data center to assure that you can optimize to maximize the ever-exploding need for compute?’” Schulman said. “And while that data center connectivity demand is exploding, there’s an equal amount of desire and demand to power inference models and applications that need ultra-low latency, like robotics or remote surgery, autonomous driving, and move that out into the edge, as opposed to these big, massive data centers.”

Beyond repurposing dark fiber for hyperscalers’ AI data centers, Verizon is in the early stages of retrofitting some of its own central offices—locations that house the physical equipment for Internet and mobile networks—to become small data centers. According to a report by the nonprofit Tech Transparency Project (TTP), Meta Platforms Inc. has violated its own advertising policies by allowing thousands of ads for AI-driven "nudify" applications on Facebook and Instagram. These ads have been primarily disseminated by GatherOne Inc., a Beijing-based advertising partner that facilitates access for Chinese companies seeking visibility on Meta’s platforms. The TTP findings indicate that over 7,600 ads for mobile applications capable of swapping women's faces onto naked bodies—and even producing sexualized content—have been run recently. One particular app flagged in the report has been criticized for enabling the sharing of material categorized by some users as child pornography.

Meta’s advertising policies explicitly forbid sexually suggestive content, including ads for apps that strip images of individuals. Yet, TTP's investigations have revealed that major tech firms, including Apple Inc. and Alphabet Inc., have struggled to effectively eliminate access to such problematic applications. This has led to calls for increased accountability from regulators, victims, and their families regarding the proliferation of deepfake pornography.

Katie Paul, director of TTP, remarked, “Meta seems to be turning a blind eye to the violations of one of its main advertising partners in China concerning nudification ads.” Although Instagram and Facebook are not available in China, they remain appealing platforms for Chinese enterprises targeting global markets. Paul interpreted the findings as an indication that Meta may prioritize advertising revenue over user safety.

A representative from Meta, Cindy Southworth, emphasized the company’s stance on banning non-consensual intimate imagery and nudification apps, elaborating that advertisers found in violation of these policies may face penalties, including ad cancellations and account terminations.

GatherOne has responded to inquiries by stating that it adheres to Meta's advertising policies and all relevant international regulations. The company claims to uphold a strict no-tolerance approach towards deceptive practices, explicit content generated without consent, child exploitation, and other fraudulent activities. It supports a variety of industries, including gaming, e-commerce, and finance, by helping them purchase ad placement across platforms like Meta, Google, TikTok, and X (formerly Twitter).

In light of the controversy, GatherOne announced it would halt the creation of new advertising accounts related to AI nudification and face-swapping services while simultaneously implementing compliance upgrades to adapt to the evolving landscape of synthetic media.

The Tech Transparency Project operates as a research entity under the Campaign for Accountability, a nonpartisan organization that monitors corporate and government behavior.

The report is set to be released on Monday and sheds light on how Meta generates revenue from a market of 1.4 billion people where its services remain inaccessible. Chinese businesses aiming to sell products or services internationally often rely on intermediary firms like GatherOne to navigate advertising on global platforms.

For the 2024 fiscal year, Meta reported $18.4 billion in sales from China, making up approximately 11% of its overall revenue and more than doubling its figures from 2022. However, the company has not provided a breakdown of revenue specifics following this.

Sarah Wynn-Williams, a former Meta executive and whistleblower, testified to Congress last year about the tools Meta has allegedly provided to China over the years, enabling the country to advance its position in the global AI arena. She pointed out that China remains a critical market for Meta, evidenced by its ongoing revenue streams from the region. Wynn-Williams is set to share her experiences in her upcoming memoir, "Careless People."

In December, Reuters reported that Meta's internal documents suggested that approximately 19% of its China revenues stemmed from ads promoting prohibited content, such as pornography and scams, with GatherOne identified as an agency involved in facilitating such ads. Meta denied the accuracy of this report but reaffirmed its commitment to combating fraud and illicit activities on its platforms.

Between April and June, TTP discovered and documented numerous ads that Meta ultimately removed after they were shown to users. These ads often displayed suggestive images of young women alongside text claiming, "Create a video with any face."

Notably, GatherOne is listed on Meta’s business website in China, serving as one of 11 approved agents for advertising on its foreign networks. Their website even features a photograph showing their CEO receiving an award alongside Meta executives at a January event in Hong Kong.

In the previous year, Meta indicated it was undertaking measures to crack down on deepfake nudification applications and initiated a lawsuit against a Hong Kong-based developer involved in such services.

TTP’s findings also revealed a particular app, BAfter, which provided users with pornographic face-swapping options. The app was reportedly available on the Google Play store, where reviewers flagged it for containing illegal child pornography. The app was subsequently removed from the platform, and GatherOne stated that it has cut off all advertising access for the associated parties.

In response to inquiries from Bloomberg, Meta confirmed that it had banned BAfter and disabled links to several other nudifying apps. Google has not provided comments regarding the situation.

A recent survey conducted by George Mason University found that over half of 557 teenagers in the U.S. had utilized nudification tools to create images of themselves or others, with a significant number reporting experiences as victims of such tools. According to Chad M.S. Steel, a researcher in digital forensics at George Mason, many teenagers are already familiar with accessing these services, suggesting that actions taken by social media platforms or app stores may have limited effectiveness in curbing their availability.

The Take It Down Act, signed into law by President Donald Trump last year, criminalizes the publication of non-consensual sexual content and mandates social media operators to remove such posts. The Federal Trade Commission began enforcing this law in May.

TTP discovered the connection between the ads and GatherOne by analyzing disclosures in Meta’s ad library. While the extent of app installations driven by these ads remains unclear, initial data indicates that a few of the apps studied have collectively amassed over 2.5 million downloads worldwide, according to market analysis firm AppMagic, as reported by TTP.

Meta Platforms Inc.’s Facebook and Instagram have served thousands of ads for AI “nudify” apps in breach of the company’s policies, delivered by one of its few advertising partners in China, according to the nonprofit Tech Transparency Project.

Beijing-based GatherOne Inc., which connects Chinese firms seeking to advertise on Meta’s social media services with the US company, has been responsible in recent months for some 7,600 ads for mobile apps that can transpose women’s faces onto naked bodies and create sexualized videos, the agency said in a new report. It singled out an app, created in China, that allows for the sharing of material some users have flagged as child pornography.

Meta’s rules prohibit sexually suggestive ads or those for apps that purport to strip the persons depicted. But TTP’s work, which aims to hold Big Tech companies to account, shows repeated failures from the likes of Apple Inc. and Alphabet Inc. to curb such apps. Regulators, victims and their families around the world have been calling on tech firms to do more to combat so-called deepfake porn services.

“Meta appears to be giving a free pass to one of its top Chinese advertising partners when it comes to nudify ads,” said Katie Paul, TTP’s director.

While Instagram and Facebook aren’t available in China, they’re attractive promotional tools for China-based businesses looking for a global audience. Paul said her agency’s findings contradict Meta’s statements about prohibiting ads for deepfake-nude apps and suggest the company prioritizes ad revenue over concern for its users.

“We do not allow non-consensual intimate imagery or nudify apps on our platform and we take aggressive steps to combat them,” said Cindy Southworth, Meta’s Head of Women’s Safety Policy.

“All advertisers have to comply with our advertising standards, and failure to comply with our policies and standards can lead to the cancellation of ads placed, financial penalties, and termination of ad accounts,” a Meta spokesperson said.

GatherOne said it complies with Meta’s advertising policies and all applicable international legal frameworks. The company maintains a zero-tolerance policy against deceptive practices, adult content, non-consensual explicit AI-generated material, child exploitation and fraud, it said. Its website says it works with clients in gaming, e-commerce, entertainment and finance, helping them place ads across the networks of Meta, Alphabet’s Google, ByteDance Ltd.’s TikTok and Elon Musk’s X.

GatherOne is suspending the creation of new advertising accounts for services related to AI nudifying and face-swap services, it said in response to queries from Bloomberg News. It added that it is undertaking a comprehensive compliance upgrade to address the technical evolution of synthetic media.

TTP is a research arm of the Washington, DC-based nonpartisan corporate and government watchdog Campaign for Accountability.

The report, due to be published Monday, provides a rare look at how Meta derives revenue from a country of 1.4 billion people where its services are blocked. Companies in China selling products and services outside the country use intermediaries like GatherOne to buy access and exposure to international users.

Meta said it made $18.4 billion in China sales for the year ended 2024, which amounted to 11% of its global revenue. That was more than double the sales it made there in 2022. It has not broken out its China revenues since.

Sarah Wynn-Williams, a former Meta executive turned whistleblower, testified before Congress last year that the company has over the years offered censorship tools to China and helped the country advance in the artificial intelligence arms race with the US. She said China remains a key market for the company, as demonstrated by its ongoing China revenues. Wynn-Williams’s 2025 memoir Careless People details her time as director of public policy at the company.

A Meta spokesman at the time disputed Wynn-Williams’ comments.

Reuters in December reported that internal Meta documents showed the company concluded in 2024 about 19% of its China revenues that year came from ads for banned content such as pornography, scams and illegal gambling. It cited GatherOne as an ad agency that its tests showed facilitated ads for scam services.

Meta disputed the accuracy of Reuters’s report at the time. It has said it is dedicated to rooting out fraud and scams, which are spiking across the internet, and takes action when it determines its rules are violated.

The ads this year, which TTP found between April and June, were eventually removed by Meta after being shown to users. Many of the ads were suggestive, showing images of young women in sexual poses along with text reading “Create a video with any face.”

GatherOne is listed on Meta’s business-facing website in China as a way to advertise on its social media services overseas, as one of 11 official agents. The GatherOne website displays a photo of what appears to be its chief executive officer receiving an award, standing beside two top Meta executives at a gathering in Hong Kong in January. Meta last year said it was cracking down on deepfake-nude apps, filing a lawsuit against a Hong Kong-based app developer it said was behind such services.

TTP found that one cluster of ads directed users to an Android app called BAfter. Upon opening it, TTP found a “ShareZone” section that offered pornographic face-swap options showing women engaged in sexual acts.

Several reviewers flagged on the app’s Google Play app store page what they describe as “illegal child porn” and AI videos of minors. BAfter, whose developer is shown as being based in China’s southern Guangxi province, is listed as suitable for all ages.

BAfter’s developer couldn’t be reached for comment. The app disappeared from Google Play on July 21 and GatherOne said it’s permanently terminated all advertising access for the associated entity.

In response to Bloomberg’s queries, Meta said it has banned BAfter and is no longer allowing links to several other nudify apps. Google, which develops the Android operating system and operates the Google Play store, did not respond to requests for comment.

More than half of 557 teenagers surveyed recently in the US by George Mason University said they had used nudification tools to create at least one image of themselves or others. More than a third reported being victims of such tools. Many teens already know how to access those services via messaging apps or directly via their websites, said Chad M.S. Steel, a George Mason digital forensics researcher who led the survey. That means actions taken by social media services or app stores to limit their spread may have limited impact, he said.

President Donald Trump last year signed the Take It Down Act, which criminalizes the publication of non-consensual sexual content and forces social media and website operators to remove such posts. The Federal Trade Commission commenced enforcement of that law in May.

TTP discovered that ads were connected to GatherOne by examining disclosures in Meta’s ad library. While it is unclear how many app installations the advertisements drove, a handful of those that the group studied have collectively been downloaded more than 2.5 million times globally, according to data from market researcher AppMagic provided by TTP.
